JEFFERSONVILLE —
No charges will be filed against the two Jeffersonville police officers or the patron involved in a fight at a Jeffersonville bar in the early morning hours of Nov. 24, the Office of the Clark County Prosecutor released in a statement today.
Maj. Leslie Kenny Kavanaugh Jr., 40, and officer Toby Deaton, 39, of the Jeffersonville Police Department were off-duty when they were involved in a fight with 27-year-old Lucas Wohlleb, of Jeffersonville, at about 2:15 a.m. inside Lighthouse Restaurant and Lounge at Main and Market streets.
Wohlleb was struck several times by Deaton, according to Deaton’s statements made after the incident.
Clark County Prosecutor Steve Stewart provided in a statement that after his review of case reports submitted by JPD and Indiana State Police and transcripts of the statements taken from 17 witnesses present at the Lighthouse, it is his conclusion that Kavanaugh and Deaton did not commit actions appropriate for criminal prosecution.
Stewart determined that although Wohlleb suffered a black eye and swollen lip during the altercation, he was very intoxicated at the time, and it was he who acted as the initial aggressor.
Stewart reached his conclusion after his office was provided the finding of an independent investigation conducted by ISP, which was requested by Jeffersonville Mayor Mike Moore and Jeffersonville Police Chief Chris Grimm on Nov. 30.
