> SOUTHERN INDIANA —
A New Albany man charged in three residential burglary cases pleaded guilty to all charges just before he was scheduled to begin trial in Clark County Superior Court No. 1 on Tuesday.
Elbert W. Franklin, 53, pleaded guilty to a July 2009 attempted burglary, September 2009 attempted burglary and a January burglary and to being a habitual offender. The plea agreement calls for him to receive a 30-year sentence, 20 years to serve in prison, five years of home incarceration and five years of supervised probation.
“He is a career criminal, and I think Clark County is very much safer with him serving a long sentence in prison,” Clark County Chief Deputy Prosecutor Jeremy Mull said.
His attorney, Stephen Beardsley, did not return a message seeking comment.
Franklin has a prior burglary conviction in Floyd County and at least six burglary or theft convictions in St. Joseph County in Northern Indiana.
Jurors already had been called to the courthouse when the plea agreement was reached but were sent home. A sentencing date was set for Oct. 12.
