A Louisville man has reached a plea agreement for involvement in a 2007 shooting on Culbertson Avenue in New Albany.
Patrick R. Fuller pleaded guilty to class B felony aggravated battery and class C felony battery resulting in bodily injury in Floyd County Circuit Court. Under the terms of the plea agreement, Fuller would be sentenced to 11 years at the Indiana Department of Correction and five years of probation.
Judge J. Terrence Cody will decide to accept or reject the plea deal at a sentencing hearing June 25.
The New Albany Police Department alleges that on Sept. 20, 2007, Jeremy L. Ogan, of Jeffersonville, shot Jeremy D. Schneider, 26, one time in the stomach in the rear of Schneider’s residence at 1743 Culbertson Ave.
Schneider was transported to University Hospital in Louisville for surgery and survived the shooting.
Fuller was charged with aggravated battery from the incident. Kristy L. Johnson, of Louisville, was charged with pointing a loaded firearm at a person, a class D felony, and assisting an aggravated battery, a class B felony. Ogan was charged with class A felony attempted murder.
All three suspects were 18 at the time of the shooting.
Fuller and Ogan allegedly ran to a house at 1816 Elm St. and surrendered peacefully after the Floyd County SWAT team was called to the scene.
As part of his plea agreement, Fuller will be required to testify against Ogan and Johnson if their cases go to trial. Johnson’s case is scheduled for trial June 29. Ogan’s trial is scheduled to begin July 6.
In October, Fuller was charged with battery for fighting while in jail. The plea agreement calls for an eight-year prison sentence on that charge, but the sentences will run concurrently, resulting in no additional jail time.
Fuller has been in jail since his arrest the night of the shooting.
