FLOYD COUNTY —
Indiana Attorney General Greg Zoeller announced Thursday his office will appeal the ruling that removed Floyd County Prosecutor Keith Henderson from David Camm’s third murder trial due to a book deal.
The Indiana Court of Appeals ordered by a 3-0 decision Nov. 15 that Henderson be removed from the case after Camm’s attorney petitioned against his involvement due to the book deal.
In 2009, Henderson’s agent negotiated a publishing agreement with Berkley Penguin Group to print a book by Henderson about the Camm case to be tentatively called “Sacred Trust: Deadly Betrayal”, according to records introduced by Camm’s defense team.
Henderson later informed his agent that he was “committed to writing the book” but that it would have to be published after the third trial.
In a news release issued Wednesday afternoon, Zoeller defended Henderson’s right to represent the state in the case.
“Prosecutors as elected officials need to be able to speak freely following a conviction in order to maintain the public confidence in our system of justice,” Zoeller said.
“After consulting with the Indiana Prosecuting Attorneys Council, we have decided to ask the Indiana Supreme Court to review the appellate court’s ruling and provide guidance on this important issue, and we ask that the prosecutor be allowed to remain on this case.”
Camm was found guilty twice in the September 2000 murders of his wife and two children who were found at the family’s residence in Georgetown. The Indiana Court of Appeals overturned the first conviction, and the second was rejected by the Indiana Supreme Court.
