New Albany man arraigned on sexual misconduct charges

Girl was 15 at the time

FLOYD COUNTY —  A 28-year-old man from New Albany was arraigned on a charge of sexual misconduct with a minor Monday.

Eric Hunter faces a class B felony charge stemming from two accusations of engaging in sexual intercourse with a 15-year-old girl.

According to a probable cause affidavit, Hunter was first told by the girl she was 16 years old before the first incident on Dec. 4, 2010, but later received a text message from her telling him she was 15 years old.

The girl said in her statement he responded, saying they should both pretend they were 18.

After the first incident, the girl said they had intercourse again on Dec. 7.

At his arraignment, Hunter’s bail was reduced from $75,000 to $50,000 cash or surety. His bond was received after his arraignment.

The court entered a preliminary plea of not guilty and set a pre-trial for Feb. 24. His jury trial is scheduled for June 6.

If convicted, Hunter faces up to 20 years in prison and a $10,000 fine.
