Jeffersonville man sentenced in cocaine case

Two cases resolved after jury conviction

JEFFERSONVILLE — A Jeffersonville man was sentenced Monday to six years in prison on drug charges.

A Clark County Circuit Court No. 2 jury found Joseph S. Cousins, 27, guilty in November of class C felony possession of cocaine, but not guilty of class A felony possession of cocaine with the intent to distribute.

Following the trial, an agreement was reached to resolve another pending case, and Cousins pleaded guilty to class D felony possession of marijuana and class A misdemeanor resisting law enforcement. Judge Jerry Jacobi sentenced Cousins to four years in prison for the jury trial case in addition to two years in prison and two years probation for the other case.

Prosecutors asked for the maximum eight years for the case that went to trial due to Cousins’ criminal history. He has five felony convictions.

“We would have liked a higher sentence on the jury trial case, but we’re happy with the aggregate sentence,” Clark County Deputy Prosecutor Jake Elder said.

Jeffersonville Police Department Officer Greg Seifried stopped Cousins on June 20, 2009, after he crossed into oncoming traffic and nearly struck the officer’s vehicle. Before the officer could initiate the stop, Cousins pulled into a parking lot at a housing complex. Video from the police car appeared to show Cousins throwing something from his vehicle.

A person in the area called the officer’s attention to a bag about 15 to 20 feet from the suspect’s vehicle along Meigs Avenue. The bag contained 9 grams of cocaine.

Cousins’ attorney, Niles Driskell, argued the state could not prove Cousins was in possession of the narcotics. The officer did not see the cocaine, and it was not clear what was in the bag.
